By creating an account or using Cantivy services, you confirm that you have read, understood, and agreed to these Terms of Use. Read them carefully before proceeding.

1. Acceptance of the Terms

These Terms of Use ("Terms") constitute a legal agreement between you ("User") and Cantivy ("Cantivy," "we," or "our") regarding your use of the platform available at cantivy.com and in our mobile applications.

By accessing, registering for, or using any platform feature, you state that you have read, understood, and fully accepted these Terms. If you do not agree with any provision of this document, you are not authorized to use our services.

You must be at least 13 years old to use our services. Users between 13 and 18 years old need authorization from a legal guardian to purchase paid plans.

2. Service Description

Cantivy is an AI-assisted music creation platform that offers the following features:

  • Generation of complete songs from text descriptions (prompts);
  • Free music tools, including a tuner, metronome, virtual piano, BPM counter, chord generator, audio recorder, and format converter;
  • Support for more than 32 musical styles, with an emphasis on Brazilian genres;
  • Storage and management of music created on the platform;
  • Export of audio files in the available formats.

Cantivy reserves the right to modify, suspend, or discontinue any platform feature at any time, with or without prior notice, without incurring liability to the User.

3. User Account

3.1 Registration

To access the platform's full features, you must create an account by providing true, accurate, current, and complete information. You are responsible for keeping this information up to date.

3.2 Account Security

You are responsible for keeping your login credentials (email and password) confidential and for all activity carried out through your account. Do not share your credentials with third parties. If your account is accessed without authorization, notify us immediately at contato@cantivy.com.

3.3 One Account per User

Only one account per person is permitted. Creating multiple accounts to bypass free-plan limits or usage policies is prohibited and may result in the termination of all associated accounts.

3.4 Business Accounts

If you are creating an account on behalf of a company or organization, you state that you have the authority to bind that entity to these Terms, and "you" refers both to the individual and the entity.

4. Acceptable Use

4.1 Permitted Uses

You may use Cantivy to create music for personal, commercial, educational, or artistic purposes, within the limits of your subscription plan and the restrictions described in these Terms.

4.2 Prohibited Uses

You are expressly prohibited from using Cantivy to:

  • Create content that violates Brazilian or international laws or regulations;
  • Generate songs with lyrics or elements that promote hate speech, discrimination, violence, child pornography, or any illegal content;
  • Reverse engineer, decompile, disassemble, or attempt to obtain the platform's source code;
  • Use automated systems, scrapers, or bots to access the platform without written authorization;
  • Attempt to overload, interfere with, or compromise the security of our infrastructure;
  • Use the platform to deliberately create songs that infringe third-party copyrights;
  • Resell, sublicense, or redistribute access to the platform without authorization;
  • Falsely represent that songs generated by Cantivy were composed entirely by humans in contexts where that distinction is relevant.

Cantivy reserves the right to investigate violations and take appropriate action, including suspending or terminating accounts.

5. Intellectual Property

5.1 Platform and Technology

Cantivy, including its AI technology, interface, source code, design, brand, logos, and all platform elements, is exclusively owned by Cantivy and protected by Brazilian and international intellectual property laws.

5.2 AI Models

The artificial intelligence models and algorithms used to generate songs are owned by Cantivy. Use of the service does not transfer any rights to the underlying technology to the User.

5.3 Trademarks

The name "Cantivy" and its logo are Cantivy trademarks. You may not use our trademarks without prior written authorization, except to refer to our product in a descriptive and neutral manner.

6. User Content and Generated Songs

6.1 Your Ownership of the Content

Songs generated by the platform based on your prompts and creative choices belong to you, subject to the conditions described in this section and your subscription plan. Cantivy does not claim ownership of the songs you create.

6.2 License to Cantivy

By using our platform, you grant Cantivy a worldwide, nonexclusive, royalty-free, sublicensable license to use, reproduce, and process the prompts you enter, solely to operate and improve the service. We will not use your prompts for marketing purposes without your authorization.

6.3 Commercial Use

Users with paid plans are entitled to use generated songs commercially. Free-plan users must review the specific plan terms, which may restrict commercial use. In all cases, we recommend including "created with Cantivy" in the credits where applicable.

6.4 Responsibility for Content

You are solely responsible for the content of your prompts and your use of generated songs. Cantivy is not responsible for any copyright conflicts resulting from prompts that explicitly reference copyright-protected works.

6.5 Third-Party Content

Our system is trained to create original songs, but we do not guarantee that the result cannot incidentally resemble existing works. We make no legal warranties regarding the absolute originality of generated songs.

7. Payments and Subscriptions

7.1 Paid Plans

Cantivy offers subscription plans with recurring billing, whose prices and terms are described on the pricing page. Prices are stated in Brazilian reais (BRL) and already include applicable taxes.

7.2 Billing

When you subscribe to a plan, you authorize Cantivy to automatically charge the corresponding amount to the payment method on file at the start of each billing period (monthly or annual). The subscription renews automatically until canceled.

7.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. There are no prorated refunds for unused periods, except as required by law.

7.4 Refund Policy

We offer a full refund within 7 calendar days after the first subscription to a paid plan, as provided under the Consumer Protection Code (Law 8.078/90). Refund requests must be sent to contato@cantivy.com.

7.5 Nonpayment

If a payment fails, we will attempt to process the charge again for up to 3 days. After that period, the account will be downgraded to the free plan until payment is brought up to date.

7.6 Price Changes

Cantivy reserves the right to change plan prices. Price changes will be communicated by email at least 30 days in advance. If you do not agree with the new price, you may cancel your subscription before the next renewal.

8. Free Plan and Limitations

Cantivy offers free access to certain tools and features, subject to usage limits established on our pricing page. The free plan may be changed or discontinued at any time.

Free features do not include priority support, high-quality export, or commercial use without platform credits. Music tools such as the tuner, metronome, virtual piano, and others remain free without usage limits for all users.

9. Termination

9.1 Termination by the User

You may close your account at any time by accessing your account settings or sending a request to contato@cantivy.com. After closure, your data will be handled according to our Privacy Policy.

9.2 Termination by Cantivy

Cantivy may suspend or terminate your account, with or without prior notice, in the following situations:

  • Violation of these Terms of Use;
  • Fraudulent or abusive use of the platform;
  • A request from competent authorities;
  • Extended account inactivity (more than 24 months on the free plan).

9.3 Effects of Termination

After account termination, your right to use the service ends immediately. Songs saved on the platform may be deleted. We recommend downloading all songs before closing your account.

10. Limitation of Liability

To the fullest extent permitted by applicable law:

  • Cantivy provides the platform "as is" and "as available," without express or implied warranties of fitness for a particular purpose or freedom from errors.
  • Cantivy is not liable for indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the platform.
  • Our total liability to you for any claim is limited to the amount you paid Cantivy during the 12 months preceding the event giving rise to the claim.
  • Cantivy does not guarantee that generated songs will be free from any third-party copyright claims.

Nothing in this section excludes or limits Cantivy's liability for fraud, willful misconduct, or any other liability that cannot be excluded by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Cantivy, its directors, employees, and partners from any claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising from:

  • Your use of the platform in violation of these Terms;
  • The content of the prompts you entered into the platform;
  • Your infringement of third-party rights;
  • Your violation of any applicable law or regulation.

12. Governing Law and Venue

These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute arising from these Terms will be submitted to the exclusive jurisdiction of the courts of the judicial district of São Paulo, State of São Paulo, Brazil, with waiver of any other venue, however privileged.

Before resorting to the courts, the parties agree to attempt to resolve disputes in good faith through direct negotiation for a minimum period of 30 days.

13. Changes to the Terms

Cantivy may update these Terms of Use at any time. Material changes will be communicated by email at least 15 days in advance. Continued use of the platform after the new Terms take effect constitutes acceptance of the changes.

If you do not agree with the revised Terms, you must close your account before the effective date of the changes.
